  1. Limited Use Software License Agreement
  2.  
  3. This Limited Use Software License Agreement (the "Agreement") is 
  4. a legal agreement between you, the end-user and Elpin Systems, Inc.  
  5. By continuing the installation of this game program, by loading 
  6. or running the game, or by placing or copying the game program 
  7. onto your computer hard drive, you are agreeing to be bound by 
  8. the terms of this Agreement.

  10. Elpin Systems, Inc. Software License
  11.  
  12. 1. Grant of License. Elpin Systems, Inc. grants to you the right 
  13. to use the game program Way Point Zeta (VER B9.0)  which is the 
  14. demo version of our title Way Point Zeta. For purposes of this 
  15. section, "use" means loading the Software into RAM, as well as 
  16. installation on a hard disk or other storage device.  You may not: 
  17. modify, translate, disassemble, decompile, reverse engineer, or 
  18. create derivative works based upon the Software.

  20. 2.  Copyright.  The software is owned by Elpin Systems, Inc. and 
  21. is protected by United States copyright laws and international 
  22. treaty provisions.  You must treat the Software like any other 
  23. copyrighted material.
  24.  
  25. 3.  Limited Warranty.  ELPIN SYSTEMS, INC. DISCLAIMS ALL WARRANTIES,  
  26. EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED 
  27. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR  
  28. PURPOSE, AND ALL SUCH WARRANTIES ARE EXPRESSLY AND SPECIFICALLY 
  29. DISCLAIMED.  NEITHER ELPIN SYSTEMS NOR ANYONE ELSE WHO HAS BEEN 
  30. INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THIS SOFTWARE 
  31. SHALL BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL  
  32. DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH SOFTWARE  
  33. EVEN IF ELPIN SYSTEMS HAS BEEN ADVISED OF POSSIBILITY OF SUCH 
  34. DAMAGES OR CLAIMS.  IN NO EVENT SHALL ELPIN SYSTEMS' LIABILITY 
  35. FOR ANY DAMAGES EVER EXCEED THE PRICE PAID FOR LICENSE TO USE THE 
  36. SOFTWARE, REGARDLESS OF THE FORM OF QUALITY AND PERFORMANCE  
  37. OF THE SOFTWARE.

  39. Some states do not allow the exclusion of the limit of liability 
  40. for consequential or incidental damages, so the above limitation 
  41. may not apply to you.  This agreement shall be governed by the laws 
  42. of the State of California and shall insure to the benefit of ELPIN 
  43. SYSTEMS, INC. and successors, administrators, heirs and assigns.  
  44. Any action or proceeding brought by either party against the other 
  45. arising out of or related to this agreement shall be brought only in 
  46. a STATE or FEDERAL COURT of competent jurisdiction located in Santa 
  47. Clara County, California.  The parties hereby consent to in personae 
  48. jurisdiction of said courts.
